1.1 This User Agreement (hereinafter referred to as the "Agreement") is established between you and Guangzhou KuaiKang Intelligent Technology Co., Ltd. (hereinafter referred to as "KuaiKang Intelligent"), defining the rights and obligations related to your use of the "Eatspert: AI Health Pal" software and the services provided by KuaiKang Intelligent through the "Eatspert: AI Health Pal" software. Therefore, please carefully read all the contents of this Agreement before starting to use the "Eatspert: AI Health Pal".
1.2 By using the "Eatspert: AI Health Pal" software provided by Kuai Kang Intelligent, you unconditionally accept and agree to the provisions of this Agreement and the management regulations announced by Kuai Kang Intelligent, and you are willing to be bound by them. In case of any dispute, you shall bear the responsibility for not reading these terms carefully and cannot use this as a defense.
2.1 The "Eatspert: AI Health Pal" software is a diet calorie software provided by KuaiKang Intelligent. KuaiKang Intelligent offers users tools to calculate food calories using image recognition algorithms and manage their weight easily through the "Eatspert: AI Health Pal" software.
2.2 Unless otherwise expressly agreed, all new functions that enhance or strengthen the current service functions of the "Eatspert: AI Health Pal" software, including new products and services, shall automatically apply to the provisions of this Agreement.
2.3 You shall bear the necessary equipment (such as personal mobile phones and other devices related to internet or mobile network access) and fees (such as telephone fees and internet access fees for internet access, and mobile phone fees for using the mobile network) for using KuaiKang Intelligent's services.
3.1 When registering in the "Eatspert: AI Health Pal" software, you must provide true and valid identification information and promptly update it online in case of any changes. If the information you provide is not true or has not been updated or is misleading, resulting in Kuai Kang Intelligent being unable to provide or continue to provide services to you, you shall bear the losses incurred.
3.2 You understand and acknowledge that the usage rights of the Eatspert account belong solely to the original registrant. Without prior written consent from KuaiKang Intelligent, you may not transfer, gift, lend, or sell your Eatspert account and password to any third party, or allow non-original registrants to use it in any form. Otherwise, KuaiKang Intelligent has the right to ban or delete the account. If you are not the original registrant of the Eatspert account, you should immediately stop using the account, and KuaiKang Intelligent has the right to return the account to the original registrant at their request or at its own discretion. The responsibility and losses arising therefrom shall not be borne by KuaiKang Intelligent.
3.3 You are responsible for safeguarding the account and password obtained during registration. If your account or password is illegally used by others due to hacking, third-party behavior, or your own negligence, KuaiKang Intelligent shall not be responsible for any losses incurred.
4.1 You are responsible for your use of KuaiKang Intelligent's services and ensure compliance with the following principles during usage:
(1) Comply with relevant laws and regulations of China;
(2) Comply with these terms and related management regulations issued by KuaiKang Intelligent;
(3) Do not infringe on the legal rights of third parties or KuaiKang Intelligent in any form.
4.2 You shall ensure the legality and propriety of your use of the "Eatspert: AI Health Pal" software and shall not engage in behaviors such as decompiling, disassembling, or cracking the client.
4.3 Do not misuse or interfere with the services of the Eatspert: AI Health Pal software, including but not limited to using the software for illegal purposes, tampering with computer code related to the software, using logos or texts related to KuaiKang Intelligent or the software, attacking the servers of KuaiKang Intelligent, or deleting, hiding, or modifying any declarations related to the software services.
4.4 If KuaiKang Intelligent reasonably believes that your use of its services exceeds acceptable limits, it has the right to restrict your use of the services, and you shall bear the responsibility and losses arising therefrom.
5.1 KuaiKang Intelligent commits to taking necessary measures to protect the security of your personal data and privacy information stored on its servers.
5.2 Except as provided in this Agreement, KuaiKang Intelligent guarantees not to publicly disclose or provide your personal data and privacy information to third parties.
5.3 The disclosure of your personal data and privacy information in the following circumstances shall not be considered a breach of contract:
(1) KuaiKang Intelligent has obtained your explicit authorization;
(2) KuaiKang Intelligent is obligated to disclose according to relevant laws and regulations;
(3) Judicial or administrative authorities require KuaiKang Intelligent to provide information based on legal procedures;
(4) KuaiKang Intelligent discloses your information within a reasonable scope to maintain public interests or to protect its legitimate rights and interests;
(5) KuaiKang Intelligent may cooperate with third parties to provide relevant network services or use data collection tools to improve its services. In this case, if the third party agrees to undertake the same privacy protection responsibilities as KuaiKang Intelligent, KuaiKang Intelligent may disclose your information within a reasonable scope.
5.4 KuaiKang Intelligent has the right to technically analyze the overall user data of KuaiKang Intelligent without disclosing your personal data and privacy information and use the analyzed and organized statistical data.
5.5 Although KuaiKang Intelligent has made great efforts to protect users' privacy rights, it cannot guarantee that existing security measures will prevent any form of loss of your personal data and privacy information. You are fully aware of this situation and will not hold Kuai Kang Intelligent legally responsible.
6.1 The copyrights, patents, trademarks, trade secrets, and any other ownership or rights (including but not limited to the "Eatspert: AI Health Pal" software) related to KuaiKang Intelligent's services are exclusively owned by KuaiKang Intelligent. Without KuaiKang Intelligent's consent, you may not disclose or use them.
7.1 The calorie data and reference opinions provided by the "Eatspert: AI Health Pal" software are for reference only. For more professional calorie data and opinions, please consult professionals.
7.2 KuaiKang Intelligent will make the utmost effort to maintain the normal operation of the "Eatspert: AI Health Pal" software, but you shall bear the risk of using the software, and Kuai Kang Intelligent does not make any promises or guarantees. It does not guarantee uninterrupted service and does not bear any responsibility for data loss, service interruption, or any other issues caused by network bandwidth, mobile device hardware limitations, or any other reasons.
7.3 For some particularly risky features of the "Eatspert: AI Health Pal" software, we will ask for your additional confirmation. If you select confirm or actually use the relevant features, it is deemed that you understand and are willing to bear the corresponding risks. If you suffer any actual losses as a result, you shall bear the relevant losses.
8.1 The services provided by KuaiKang Intelligent are subject to risks such as force majeure, computer viruses or hacker attacks, system instability, your location, communication line issues, operational adjustments by Kuai Kang Intelligent, and adjustments by partners.
8.2 KuaiKang Intelligent may change, interrupt, or terminate part or all of the services at any time without further notice to you.
8.3 If you wish to use the services provided by KuaiKang Intelligent, you must bear the above risks, and KuaiKang Intelligent does not bear any compensation responsibility for damages suffered by you or any third party.
This Agreement's interpretation, effectiveness, and dispute resolution are subject to the laws of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan). Any disputes arising from or related to the use of KuaiKang Intelligent's services shall be submitted to the People's Court of Tianhe District, Guangzhou City, for litigation.
KuaiKang Intelligent has the right to modify this Agreement at any time. Once the terms are changed, KuaiKang Intelligent will prompt the modification on the relevant page. If you disagree with the modification, you should immediately stop using the services of KuaiKang Intelligent. If you continue to use the services of KuaiKang Intelligent after the modification of this Agreement, it is deemed that you have accepted and are willing to comply with the modified Agreement. The final interpretation right of the above content belongs to KuaiKang Intelligent.
